How to Avoid Being Battered by the Lawsuit Jungle


It can be ugly out there! Employee lawsuits are costly both in dollars and reputation. Do all you can to avoid them.

Know that every employee, former or current, has the potential to file a suit. Know that it is all too easy for a disgruntled employee to find a lawyer who will represent them. And know that it is all too difficult to avoid being dragged into court whether the suit is justified or not.

  1. What should be first on your list? Proven corporate compliance training. Start with the greatest areas of risk.  Educate your supervisors, interviewers and HR folks so they are up to date on the ever-tightening protections for employees and how they fit into your corporate culture and values.
  2. Next is consistency. Avoid liability by maintaining and implementing policies consistently. There should be no hint of favoritism or lack of transparency or accountability.
  3. Third is publishing company-wide your policies so they are well-known by all. Include a process for filing complaints and act immediately upon them.
  4. The last step is documentation. Maintain accurate records so that you can prove consistent and fair application of the rules and regulations by all.
